These Terms of Use apply to Mathew Brigante, PhD, New York State Licensed Psychologist, License No. 026659, doing business as Brigante Psychology (hereinafter, “the Practice”).

Purpose of This Website
This website provides general information about the Practice and its professional services. Website content is not an individualized psychological assessment, diagnosis, treatment recommendation, psychotherapy session, clinical opinion, risk assessment, crisis service, or emergency service.
No Psychologist–Patient Relationship Created by Website Use
Viewing this website, reading its content, submitting an inquiry, sending a message, or otherwise contacting the Practice does not by itself establish a psychologist–patient relationship, begin psychotherapy, create an obligation to provide professional services, guarantee acceptance as a patient, or guarantee any particular service or outcome.
A psychologist–patient relationship begins only when the psychologist has agreed to provide professional services and the applicable intake and informed-consent requirements have been completed.

Emergency and Clinical Communications
The website, inquiry form, ordinary email, telephone, voicemail, and electronic messaging systems are not emergency services and are not continuously monitored. They must not be relied upon for an immediate safety response.
Prospective-client inquiries, when accepted, are submitted through the SimplePractice inquiry form on the Home page. Existing patients should use the SimplePractice Client Portal and Secure Messaging for designated patient communications.
The telephone number provided anywhere on this website is for privacy, HIPAA, legal and accessibility ONLY. It is not for psychotherapy inquiries. It is not for scheduling or cancellations. It is not for referrals. It is not for clinical advice or clinical communications. It is not for risk assessment. It is not for crisis services. It is not for emergency assistance.

Professional Identity, Scope, and New York Licensure
New York Education Law Article 153 governs the practice of psychology and the use of the title “psychologist.” Only a person licensed or otherwise authorized under Article 153 may practice psychology in New York State or use “psychologist,” “psychology,” or “psychological” in connection with a psychology practice.
The Practice provides professional psychology services only within the lawful scope of psychology and only where the psychologist is licensed or otherwise legally authorized to provide the service.

Telehealth and Jurisdiction
NYSED treats telepractice as a mode of psychology practice subject to the standards that apply to psychology practice generally. A psychologist providing services to a patient located in New York State must be licensed or otherwise authorized to practice in New York State. Before providing services to a person located in another jurisdiction, the psychologist must determine whether that jurisdiction permits the service.

No Guarantee of Services or Outcomes
Descriptions of the Practice, psychotherapy, professional approach, availability, or areas of work are informational and are not guarantees of treatment, acceptance, effectiveness, cure, satisfaction, or any particular result.
New York State professional-conduct rules prohibit professional advertising that is false, fraudulent, deceptive, or misleading; guarantees a service; makes an unsubstantiated claim concerning professional services or price; or makes an unsubstantiated claim of professional superiority.

Professional Ethics and Public Statements
The APA Ethics Code requires psychologists to avoid false or deceptive public statements concerning matters including training, credentials, services, scientific or clinical bases for services, results, fees, and professional affiliations. It also requires public advice or comment through electronic or other media to be based on appropriate professional knowledge and not to indicate that a professional relationship has been established with the recipient.
The APA Ethics Code also requires reasonable precautions to protect confidential information and limits disclosure of confidential information according to consent, law, and valid professional purpose. Applicable New York State law and Board of Regents rules independently govern professional practice and professional misconduct in New York State.

Electronic Communications and SimplePractice
The Practice uses SimplePractice, LLC as an independent third-party technology and practice-management provider for the prospective-client inquiry form and for designated patient communications.
When SimplePractice creates, receives, maintains, or transmits PHI on behalf of the Practice as a HIPAA business associate, its handling of that PHI is governed by applicable HIPAA business-associate requirements and the Business Associate Agreement between SimplePractice and the Practice. The Practice remains responsible for the legal and professional duties imposed on the Practice; SimplePractice remains responsible for duties imposed on SimplePractice by applicable law and its agreements.
Ordinary email, SMS/text messaging, social media, and communications outside designated secure systems may not provide the same privacy and security protections as designated Practice systems. Sensitive clinical information should not be sent through ordinary email, SMS/text, or social media.

Third-Party Services and External Links
SimplePractice and other third-party services are not owned or operated by the Practice. Third parties independently control their own platforms, infrastructure, software, hosting, maintenance, security operations, availability, terms, and privacy practices.
To the fullest extent permitted by applicable law, the Practice does not warrant uninterrupted or error-free operation of an independently operated third-party platform and does not assume responsibility for independent third-party technical failures outside the Practice’s control. Nothing in these Terms waives, limits, or disclaims a responsibility that HIPAA, New York State law, professional standards, consumer-protection law, a binding agreement, or another applicable law does not permit the Practice to waive, limit, or disclaim.
A link to an external government, professional, or commercial website does not mean the Practice owns, controls, guarantees, or adopts that third party’s content, availability, accessibility, security, privacy practices, or legal positions.
